Introduction While hearing succession applications I often find myself suggesting to those appearing in front of me to consider forming a whānau trust.
But the philosophy of the Act in that situation is to shepherd the owners towards one of the Act’s governance structures – an approach that has been hugely successful to date and fits with the MAF report’s conclusion that good governance is the key to success.
