The benefits of a hapū partition are: no consent is needed under the Resource Management Act 1991 , and there’s no requirement for land contributions for roads, reserves, or public use or access.
You will need to provide: evidence of meetings held (including the notice) to add, reduce or replace trustees and the meeting minutes resignations (if any) for existing trustees evidence that a trustee or trustees have passed away The person(s) being becoming a trustee will also need to complete a trustee consent form to indicate that they consent to the appointment.
For these reasons the Court will facilitate an application for an urupā reservation but will also make sure that the owners and trustees have also considered these difficult but not uncommon issues.

Term of office 3.5 All trustees will serve for a term of 3 years, and two trustees will retire every year upon rotation.

See Chapter 21 for the Trustees' rights to have the Trust pay for any costs and liability incurred by the Trustees on behalf of the Trust. 1.3 Any assets acquired or contracts entered into by the Trustees on behalf of the Trust must be used and held for the benefit of the Trust and not for the personal benefit of the Trustees.

Where one or more of the trustees are unable or refuse to sign the mortgage documents, the remaining trustees can apply to the Court: (a) To seek directions; (b) To remove any trustees who have passed away or resigned; (c) To remove a trustee for cause for refusing to implement the majority decision; or (d) To approve the mortgage documents being signed by a majority of trustees only per s 227(3) and 237 of the Act. 7.
