TIP: Make sure you try all the different names an owner might be known by including nicknames,
married names, adopted, whāngai, Māori names, and names that may have been spelt incorrectly.
First, what it is that might possibly lead to a reasonable apprehension by a fully
informed observer that the judge might decide the case other than on its merits;
and
2. Second, whether there is a “logical and sufficient connection” between those
circumstances and that apprehension.
These discussions should focus on:
• the rights of beneficial owners and/or beneficiariesand shareholders
• the powers of trusteesand committee of management members
• how trusteesand committee members will perform their powers
• communicating with beneficial owners and/or beneficiariesand shareholders
• what will happen if there are disagreements.
