An example of this complexity
was the investigation of title to Mokoia Island in
Lake Rotorua, heard in 1916. Judge MacCormick,
who heard the case, complained that the Mokoia
investigation was ‘about the most unsatisfactory
case in this Court’s history’.
A sketch plan or diagram showing:
The area of the portion to be partitioned out; and
The position or locality of the partition relative to the whole block; and
Any river, lake or seashore boundaries of the whole block; and
The position of any easement or roadway required for access to the partitioned area.
For example: Tuaropaki - $667million, Lake Taupo Forest - $165million, PKW Incorporation - $162million, The Proprietors of Atihau-Whanganui - $178million, to name but a few.
If any other person subsequently becomes a party to the proceedings the lawyer
appointed and engaged must, as soon as reasonably practicable, give an equivalent
notice to the new party.
