What has changed?
LEASE OR OCCUPATION LICENSE:
Trusts over Māori reservation land may issue a lease or
occupation licenseto enable the land to be occupied or built
on for a period of time.
From
6 February 2021
On the death of a landowner, descendants can apply
immediately to succeed to the land interest.
The surviving spouse or partner does not receive the land
interest but is entitled to income from the land and tooccupy
the family home.
However, it is possible to make application to the Court to have an area excluded from a reservation pursuant to section 338(5), and then to set up an ahu whenua trust in relation to the excluded area with the object of allowing housing development to take place.
