not vest the block in a ‘tribe by name’ because
the chiefs seeking title did not ask it to, but
merely presented the Court with a list of ten
grantees, which Judge Monro did not investigate
further.
The vast majority of
trusts and incorporations function despite the fact that the engaged owners continue
to be a minority, often a mere 5 to 10% of the owners. This is the case for the largest
and most successful trusts and incorporations, such as the Tuaropaki Trust and
Mangatu Incorporation, right down to the smallest papakainga trusts.
