In
this particular instance the Court probably did
not vest the block in a ‘tribe by name’ because
the chiefs seeking title did not ask it to, but
merely presented the Court with a list of ten
grantees, which Judge Monro did not investigate
further.
The decisions of any meeting don’t bind
the Court either – the minutes and resolutions are merely
evidence of the proceedings and the resolutions reached.
The vast majority of
trusts and incorporations function despite the fact that the engaged owners continue
to be a minority, often a mere 5 to 10% of the owners. This is the case for the largest
and most successful trusts and incorporations, such as the Tuaropaki Trust and
Mangatu Incorporation, right down to the smallest papakainga trusts.
