Also, on 20 June 2014, an invitation to submit feedback on
the draft RDS was placed on the Māori land Court and Waitangi Tribunal website’s. Additionally a
noticed was placed in the Māori Land Court Panui of which held a mailing list of up to 4700.
Generally speaking, where next of kin die before the person
from whom succession is sought, the children of the next of kin are entitled to the share they would have received had they
survived the deceased.
4 Notice of hearing
While an applicant is not required to give formal notice of hearing to other beneficiaries, he or she is expected to consult with
them and advise them of the application and when it is to be heard.
But, it is my experience that not all owners will participate even with notice. It is not uncommon for a block of 100-200 owners, for meetings to attract less than 10 owners – and that is on a good day.
