Unlocking finance is an important part of facilitating the occupation, development, and utilisation of whenua Māori for the benefit of owners, their whānau, and their hapū and this practice note is another step on the road to realising this vision.
Whenua is part of the identity of tangata whenua. It is tūrangawaewae – the place where we come from, the place we belong to, the place where we can stand.
If the landowner does not take part or the review turns into a dispute, the water service provider can appeal to the Māori Land Court for a decision under section 166(4)(b) of the Local Government (Water Services) Act 2025 .

This service is voluntary, so everyone involved in the dispute must all agree to take part. In this context, tikanga-based means that the process is guided by your values, beliefs and practices as a whānau or hapū.
Māori community purposes
5.3 If approved by an order of the Court, the Trustees may apply the whole or any part of
any specified portion of the income derived from the Trust Property for Māori community
purposes in accordance with section 218 of the Act.
