expenses.
Selling Māori land to pay debts
The Act doesn’t allow estate trustees to sell Māori land to pay
the deceased’s debts.
Sometimes the Māori
Land Court is asked by the family to direct
the payment of money held (for example,
to settle the funeral account), and the Court
can do this.

ALIENATION
Alienation occurs is when landowners grant
certain rights of their land to another person(s).
For example:
• selling or gifting the land gives the
new owner the ownership rights
• leases give the lessee a limited
right to occupy land in return for
payment of rent (and other
conditions)
• mortgages give the mortgagee the
right to sell the land if the mortgage is
not repaid.

(c) To buy any land or interest in land, shares or assets whatsoever whether by way
of lease purchase exchange or otherwise AND to acquire, sell, hire or otherwise

Mortgagee sale: The right of a mortgagee to sell the land over which they hold a
mortgage, if the mortgagor has not met the agreed terms for repayment of money
loaned to them under that mortgage.
Individual land ownership made it easier for settlers to buy and sell land. However, it was in major conflict with the traditional ways of land occupation and guardianship for tangata whenua.
