The MLC regards any breaches of trust as a very serious
matter, and trustees who are found tobe at fault can expect
tobe made to pay for any losses that they have caused.
You may
be asked for further information.
The completed summary will be referred to a
Judge who may direct further enquiries tobe
made, or notice of the application tobe given
to other people who may be interested in, or
be affected by, the application.

Any officer, committee of management member, or employee of an incorporation can be required to appear in court and provide a written or oral report to a judge as part of an investigation.
You will need to provide:
evidence of meetings held (including the notice) to add, reduce or replace trustees and the meeting minutes
resignations (if any) for existing trustees
evidence that a trustee or trustees have passed away
The person(s) being becoming a trustee will also need to complete a trustee consent formto indicate that they consent to the appointment.
The Court may, on considering your notification, arrange for the application tobe set down for a formal hearing
if the application has yet tobe determined or for a rehearing if the application has already been determined.
Where appointments are made, there is a great need for trustee training programmes tobe available to ensure that new trustees understand their roles and responsibilities.
It can also order that:
• the land reverts tobeing held under the former title as if
the order hadn’t been made, or
• the land be vested in any other person it considers tobe
justly entitled to it.
