Applications for injunctive relief process over the holiday
period 2023/24

Only urgent applications for injunctive relief will be considered over the holiday period,
only between 27 – 29 December, and only from 9am-5pm.

A number of countries have now incorporated into those regulations provisions which allow arbitrators to grant urgent interim relief such as an urgent interim injunction.
On 23 March 2020, Chief Judge Isaac released a protocol advising that all scheduled Māori Land Court hearings and other events would be adjourned, to be rescheduled once we ceased to be at Level 4. 2 Any applications for urgentinjunctive or other relief filed with the Court during this period were directed to the Chief Judge to address.

(i) For the avoidance of doubt, if the parties agree to adopt the ADR process they
must complete Steps 1 and 2 of the ADR process, before the dispute can be
determined by the Court, unless both parties mutually agree in writing to opt out
before completion of the ADR process or there is a need for urgentinjunctive
relief by any party to the dispute.

Following an urgent Māori Land Court hearing held on Wednesday, 2 August 2023, the Court has directed that the five separate hui scheduled on Saturday, 5 August 2023 for the following Māori Reservations is CANCELLED:
