To transfer your land by gift or sale toa someone who is not a member of the preferred class of alienee (link to definition), you will need to apply for a confirmation of alienee.
The Court may, on considering your notification, arrange for the applicationto be set down for a formal
hearing if the application has yet to be determined or for a rehearing if the application has already been
determined.
And importantly, the Court process provides a
timely opportunity for successors to discuss and agree to their interests being vested
in awhānautrust, which has the huge advantage of curtailing any further
fragmentation of interests.
