The consent of the parties to a judge sitting is important but not determinative, as the
subjective perceptions of the parties are not relevant to whether there is a reasonable
apprehension of bias.

The purpose of the National Pänui / Te Pänui ä Motu is
to provide notice to interested parties of hearings being
conducted in, and applications received by, the Mäori Land
Court.
The Court worked by means of
written applications filed in advance by Māori
people, for example to have title to their land
investigated, to have it partitioned, for relative
ownerships to be determined, for equitable
owners to be added to the title, and so forth.
Its only purpose is to allow access to property. The Māori Land Court can grant rights of way at the time a title is created with the consent of all landowners at that time.
