In accordance with tikanga Māori there is no distinction to be drawn between whenua (land) that is dry and land that is covered by the sea.

Ōta noho (utu tāpae $68) Occupation order (filing fee $68) Occupation orders allow you to exclusively occupy or build on a specific area of Māori land. You must own an interest in the land or be the beneficiary of a whānau trust that owns an interest in the land.
The Act now clarifies that Māori Land Court judges will follow the tikanga of the hapū or iwi associated with the land being succeeded to when deciding whether whāngai can succeed to a land interest.

The owner of a beneficial interest in land. Where land is vested in trustees, the trustees own the land as legal owners on behalf of the beneficiaries.
