If an owner with Māori Land interests is deceased, and a succession has not previously been dealt with by the Court or a
Registrar, you can use this form to seek a determination from the Court as to those persons entitled to a deceased’s
Māori Land interests and an order transferring the interests to those entitled.
If an owner with Māori land interests is deceased, and probate, letters of administration or an election to administer
the estate have been granted by High Court, or is to be obtained, you can use this form to seek a determination from
the Court as to those persons entitled to a deceased’s Māori Land interests and an order transferring the interests to
those entitled.
A surviving husband, wife, or partner cannot become the owner of the land interest(s). However, they are entitled to receive any income from that land interest, including income from incorporation shares or rights to any grants, for their lifetime.
The Act now clarifies that Māori Land Court judges will follow
the tikanga of the hapū or iwi associated with the land being
succeeded to when deciding whether whāngai can succeed to
a land interest.
This means that in some cases whāngai may succeed to land
interests as if they were a birth child or grandchild of the
person who has passed.
The Formation of the Trust The next step I took was to outline this information to whānau members at a hui held on Labour weekend 2003. What was really interesting was to hear comments from cousins of mine, many of them older than me, who had heard similar stories during their lifetime but who had never, for whatever reason, been able to verify the fact that we still had some Māori land interests.
The trustees must keep an interests register that records any interest of the trustees in trust
property or any transaction or proposed transaction with the trust.
An island that is being dreamed about by Justice Williams, that was imagined by our ancestors and that we aspire to reach in our lifetime. To the justice system, a few of our dear friends have already joined our waka and are holding steadfastly their oars, it is time you joined them.
