OCCUPATION ORDER:
An occupation order provides the right to build on a piece of
land owned by multiple owners (but does not grant a title ofownership over that piece of land).

The major ownershipof the land (which has an area of 1.4011 ha situated in Whittaker Road, Rotorua) has been held since 1968 in a long-term testamentary trust for eight of the testator’s children and their descendants.
What must also be borne in mind, however, is that ever since the whole concept of individualisation was originally imposed over Maori concepts ofownership, the necessary resourcing to keep lists of owners up to date has generally been inadequate.
Perhaps the answer to the problem is that we must view land ownership as a consequence of membership of a kin group, rather than possession of a shareholding.
That information makes up the Māori Land Court record, which is the legal and official documentation of land ownershipof whenua Māori. We are responsible for the ongoing care and protection of this taonga-tuku-iho.
