freehold order (that is, the Court has created a title for theland and determined the
beneficial owners to that land).
A partition is dependent on:
agreement from the owners or a demonstrated sufficient degree of support
the value oftheland and the shares (before partition)the value ofthe new blocks (after partition)
access arrangements to each new block or blocks oflandthe distribution of interest(s) and share(s) or shareholding(s) in the new blocks ofland.
The Preamble
to the 1862 Act stated that the new legislation
would ‘greatly promote the peaceful settlement
ofthe colony and the advancement and
civilisation ofthe natives’ if their rights to land
were ‘assimilated as nearly as possible to theownershipofland according to British law’.
In the English version, Māori are said to have ceded
the sovereignty of New Zealand to Britain; Māori give the Crown an exclusive right to buy lands they
wish to sell, and, in return, are guaranteed full rights ofownership of their lands, forests, fisheries and
other possessions; and Māori are given the rights and privileges of British subjects.
