Conflict of interest arising out of legal practice
Judges should recuse themselves if they served as a legal advisor when in practice on a
matter in issue when in practice.
Before being appointed to the Māori Land Court, Judge Wara was a director of Tu Pono Legal which she co-founded in 2014. While in practice she specialised in resolving Māori legal issues, acting for clients across a range of issues in both general practice and litigation.
There is an obvious need for practical training. Māori training programmes are required to improve trustees’ understanding of land use and development issues and the governance role they are taking on.

We will need lawyers who can combine knowledge of te reo me ona tikanga, and the Treaty, with the practice of environmental law. After 15 or so years as a corporate lawyer, you can imagine my surprise to have the opportunity to join the Māori Land Court.
These changes make it easier to set up a Māori incorporation,
support good practices by incorporations, and provide
landowners with greater transparency of decisions made by
committee members.
