Conflict of interest arising out of legal practice
Judges should recuse themselves if they served as a legal advisor when in practice on a
matter in issue when in practice.
Before being appointed to the Māori Land Court, Judge Wara was a director of Tu Pono Legal which she co-founded in 2014. While in practice she specialised in resolving Māori legal issues, acting for clients across a range of issues in both general practice and litigation.
There is an obvious need for practical training. Māori training programmes are required to improve trustees’ understanding of land use and development issues and the governance role they are taking on.
This may include pōwhiri, whakatau, mihimihi, karakia, waiata, koha, kai, and other practices that you have. A pre-mediation hui will be held with all parties where you can decide on the practices that will take place at the mediation.
