For a Māori incorporation, the Māori Land
court must be satisfied that:
• the shareholders of the incorporation
have been given clear and specific notice
of the application
• the shareholders have passed a
special resolution supporting the
application.

for each type of application
Landowners’ meetings
Landowners should hold a meeting to
discuss any application affecting the land.
In your application, you’ll need to provide:
evidence that those persons holding at least 10% of the shares in the incorporation seek an investigation or
evidence that a special resolution was passed at a general meeting of the shareholders seeking an investigation
the grounds upon which an investigation is sought, and
any matters that should be brought to the immediate attention of a judge.
A judge should recuse him or herself if, in the circumstances, a fair-minded, fully
informed observer would have a reasonable apprehension that the judge might not bring
an impartial mind to the resolution of the question the judge is required to decide.
If
the problems cannot be resolved, the landowners can apply
to the MLC to:
• try and resolve issues through mediation using the Court’s
dispute resolution service
• review the terms, operation or other aspects of the trust
• add, replace or remove trustees
• investigate the trust
• enforce the terms of the trust
• vary the terms of the trust
• terminate the trust.
