SIGNING DOCUMENTS
Trustees may sign documents by a majority (more than half
of all the trustees currently appointed by the MLC) if the
trustees have passed a resolution authorising the document.
However, if the document needs to be registered against Toitū
Te Whenua – Land Information New Zealand (LINZ) title12 to
the land, then every trustee must sign it.
The Trustees recognise that they must make all decisions on behalf of the Trust and are
not bound by resolutions of the Beneficiaries.
TERMS OF TRUST ORDER

Signing documents
Trustees may sign documents by a majority
(more than half of all the trustees currently
appointed by the Court) if the trustees
have passed a resolution authorising the
document. However, if the document
needs to be registered against the Land
Information New Zealand (LINZ) title 13 to
the land, then every trustee must sign it.
Use this form to seek Court confirmation of an instrument or agreement of sale or gift of Māori Land;
or to confirm a resolution of assembled owners to transfer Māori Land by way of sale or gift.
In your application, you’ll need to provide:
evidence that those persons holding at least 10% of the shares in the incorporation seek an investigation or
evidence that a special resolution was passed at a general meeting of the shareholders seeking an investigation
the grounds upon which an investigation is sought, and
any matters that should be brought to the immediate attention of a judge.
