Where a determination or order has already been made by a Registrar, affected persons may also apply to the court to seek a review of that determination or order. A review must be lodged within 20 working days after the determination or order is made or, at the satisfaction of a Judge, within a longer period.

In the issues paper produced in April 2021 by the Law Commission entitled “Review of Succession: Rights to a person’s property on death” the paper identifies a number of tikanga that I consider to be relevant and reproduce here.

Fifth The project has also highlighted the need for the Māori Land Court to be more proactive in its identification and review of defunct trusts and incorporations due to circumstances such as the death of key trustee or management committee members.
The reform options proposed in the paper deal with every stage of the decision making process. The review also assesses how the primary legislation interfaces with other key statutes, and the respective roles central and local government and private groups should play in the provision and management of cemeteries.
With the focus of the recent review on increased productivity of land, let’s not forget the many trusts and incorporations that already do a great job and are success stories that have been celebrated this weekend.
The changes to the existing Practice Note were made following a review undertaken by Judge Warren, with helpful input from lawyers who regularly appear in our Court.
