Accretion and final orders
In terms of the accretion, LINZ guidelines state that to establish an accretion claim the
following three components must be present:
1.
Tū Atu
Taking the hui from a state of sacredness to a state
or ordinary, this is where we want our landowners
to be ready for the next chapter in their journey,
whether this continues inside or outside of our
Court.
In assessing costs against a party in receipt of funding from the Special Aid Fund, the
Māori Appellate Court has stated:9
We consider that a grant of special aid is relevant to both stages of the inquiry on
costs, being whether costs should be awarded, and if so, in what amount.
CROWN
The Crown refers to the head of state of New Zealand.
The current head of state is Her Majesty Elizabeth the
Second, by the Grace of God, Queen of New Zealand
and Her Other Realms and Territories, head of the
Commonwealth, Defender of the Faith.
When the life tenant dies, their right to life
interest finishes. Many life interests state
that the life interest will terminate if the
life tenant remarries.
18 A person’s genealogy, or family tree, linking
that person to a particular family and/or
ancestor.
19 A trustee/guardian.
20 A person adopted informally in terms
of tikanga Māori and brought up as the
adopting parent’s own child without formal
adoption being concluded by any court.
