The early history of individualisation leading to land dispossession and alienation and the impact this system of tenure wrought on Māori society has been rehearsed time and time again before the Waitangi Tribunal.
Section 4 of Te Ture Whenua Māori Act 1993 lists the preferred classes of
alienees in relation to any alienation. In considering applications relating to
alienations, the Māori Land Court must be satisfied that the preferred classes of
alienee have been granted an opportunity to exercise the first right of refusal.
