We can only ever control and be responsible for our own responses in
challenging situations. Take some time to reflect on the following:
What are the best possible outcomes for you?
The main priorities for the Court now are first, to remedy errors in the lists, using s 86 of TTWMA, and second, to update the list of successors based on previous and new evidence, the latter of which requires hearings to be held so evidence can be heard. An applicationform based on the existing form for successions has been modified for the purposes of SILNA determinations, and individual applications are linked to a central file to ensure consistency.
Disclosure of any matter which might give rise to objection should be undertaken even if
the judge has formed the view that there is no basis for recusal.
But the real challenge remains what it has always been for us all – the administration of Māori land and the delivery of services in accordance with the aspirations or rangatiratanga of Māori to retain, utilise and develop their land for the benefit of the owners, their whanau and hapu in accordance with their own cultural preferences.
