The Court must be satisfied that the beneficiaries have had sufficient notice of the application to vary the trust order, and sufficient opportunity to discuss and consider it.

Appeals to Māori Appellate Court - in relation to a decision of the Māori Land Court Under section 171 of the Local Government (Water Services) Act 2025, parties may appeal to the Māori Appellate Court on a question of law only in relation to a decision of the Māori Land Court around access to Māori land for water infrastructure.
Until such an application is made there is no guarantee as to how the Court would view the matter and the success of any such application would depend on its own facts.
This produced some pleasing results in both spaces with an increase in new applications to Court in the earlier part of the reporting year and the closure of some of our older applications.
