Share transfers can be arranged directly with the Māori incorporation or by an order of the MLC. However, the MLC only deals with Māori incorporation share transfers where successions or trusts are concerned.

The “exceptional initiatives” (as I term them) that do require Court orders are sales, long-term leases, change of status, title reconstruction and improvement, and occupation orders.

If this is not done, the Court may direct that formal notice be given to the beneficiaries. 5 Wills Wills do not apply to these successions to SILNA Lands under the Court’s inquiry under section 29 of Te Ture Whenua Māori Act 1993.
Before 6 February 2021 A beneficiary of a whānau trust is not able to apply for an occupation order to use trust land for housing purposes.
