The parties involved in the dispute will need to agree on the
mediator to be used, or one can be appointed for you.
You can apply for the dispute resolution service through one
of our offices.
In the application, you’ll need provide proof that:
other owners have been given notice of the creation of the trust
a hui was held, and an agreement was reached
the terms of the trust have been proposed
consent has been given to create the trust or incorporation
the trustees to be appointed have consented to their appointment Committee of Management Members have been nominated.
As in all trustee appointments, these are made by the Court. That forum is where any beneficiaries may raise objections to appointments (criminal convictions or whatever).
These need not be terminated upon appointment to the bench,
and subject to actual conflicts of interest arising from knowledge of clients or
circumstances, such connections should not generally affect a judge’s impartiality.
