The
extent to which they are included depends on:
• whether they are related by blood to the deceased
• their connection to the whenua
• the tikanga of the relevant iwi or hapū
Payment of funds
Section 242 of Te Ture Whenua Māori Act 1993
If money is being held on behalf of the deceased by a trust or incorporation, the Court can make an
order for the payment of those funds to the people determined entitled under the succession
application.
There are two application types you can file under section 214 of Te Ture Whenua Māori Act 1993
and rule 12.3 of the Māori Land Court Rules 2011 to form a whānau trust.
Based in Wellington, he is the resident judge for Tākitimu, but also provides support for hearings around the country.
Before being appointed to the Māori Land Court, he was the Managing Partner of a specialist Māori law firm where he acted for a number of Māori clients around the country on a range of issues, including Treaty of Waitangi settlement negotiations, Waitangi Tribunal claims, commercial negotiations and contract drafting, corporate and commercial law and litigation.
