1. Introduction
The question of recusal is one that all judges must make themselves, having regard to
the particular circumstances before them.
See Erceg v Erceg [2016] NZSC 135, [2017] 1 NZLR 310 at [2], where
the Supreme Court emphasised the constitutional significance of open justice and media
reporting of court proceedings.
