CHECKLIST
The purpose of this checklist is to provide a reference to the terms within this draft trust
order which require further consideration by the owners.
The process is the same to set up each type of trust
(except kaitiaki trusts) – the owners first need to have a meeting
at which they:
• agree to set up the trust
• agree which blocks of land or shares should be included in
the trust
• agree to the terms of the draft trust order8 which sets out the
trustees’ powers, rights and obligations
• nominate trustees
• take accurate minutes.
Over and above these roles, they have all found
time to deliver speeches, participate in seminars or
conferences, contribute to the Māori Land Court’s
business operations including the development
of draft rules for the Court, develop a Banking
Practice Note (led by Judge Armstrong) and a
Special Aid Practice Note (led by Judge Warren),
and participate in judicial committees of the Chief
Justice.

significant interest in the Courts work (for example Waitangi Tribunal, Te Puni Kōkiri, Land
Information New Zealand), law firms with a long standing interest and participation in the Court’s

history, law and Māori studies departments) and Treaty historians.
