1.5. Permanent Record of the Court
The Māori Land Court and Māori Appellate Court are courts of record and have all the powers and
duties that are inherent in a court of record.
The rapid pace of Treaty settlements has created challenges for the Tribunal, and the number of the applications in the Māori Land Court continues to rise as well. Just before I wind up, I want to make a few brief comments about the Court and the Tribunal.
Evidence and decisions
are recorded in a separate minute book series.
• Appellate Court: Established as the Native
Appellate Court in 1894, the (now) Māori
Appellate Court has its own minute book series
It also holds information about the whakapapa of landowners. It includes:
Court files (the physical and electronic application file that holds all documents and correspondence about a matter in the Court)
Minute books (the physical copy of all conversations and decisions made by the Court)
Court orders (the decisions made by a Registrar or the Court)
Instruments of alienation (the legal tool used to make changes to a land block)
Block order files (the phy...
The application to the Court
The application was not contentious, however there were two issues for the Court to
determine:
(1) The area of land had no LINZ title, nor any current title in the Court’s records.
This schedule does not include applications that have been set down for hearing, are before the
Court for determination, have been determined by the Court and/or are awaiting release of any
decision, determination or order of the Court.
