Succession to Māori land interests can be complex for whānau
and for whāngai, and Māori land is often owned by members
of different whānau (with different views on whāngai
succession).
The mortgage can be approved by a majority of the members of the Incorporation’s
committee of management, provided that the majority cannot be less than three members
of the committee (s 270(2) of the Act).

For example, if this Order empowers the Trustees to use Trust income for Māori
community purposes, the Trustees may use that income to fund healthcare for the local hapū/iwi
members, even where those individuals are not Beneficial Owners of this Trust.
