A trustee who refuses to sign it without
making such an application could be in a very awkward
situation if the trust suffers losses as a result.

The changes affect all trusts,
including Māori landtrusts created through the Māori Land Court
(such as ahu whenua, kaitiaki, and whānau trusts) and existing
trusts established before the law came into force.

Applications for Succession, Whänau Trust or Kaitiaki Trust to be
heard in other Court Districts
The following applications affecting land in this district will be heard under rule 5.2 of the Mäori
Special fixtures are arranged and advertised in accordance
with the provisions of the Mäori Land Court Rules and they
may not necessarily be listed in this publication.
They have now agreed to put those tensions behind them as it relates to the land (rather than personalities!) and have adopted this ahu whenua/whānau trust structure.
The process for constituting an ahu whenua or whenua tōpū trust is similar. Both trust types are
land management trusts involving one or more Māori freehold land blocks (and in some cases,
general land owned by Māori).
