When an executor is confirmed by the High Court, that Court issues probate in his/her favour. If the will does not name an executor, then the person who is appointed by the High Court to administer the estate is called an administrator.

For the avoidance of doubt, a trustee or former trustee is not entitled to such indemnity where his or her liability is attributable to his or her own dishonesty, or to the wilful commission or omission by that persons of an act that he or she knew was a breach of trust or where he or she acted in reckless disregard of whether it was a breach of trust.
