Simple and uncontested applications
Succession and trust applications that are uncomplicated
and unopposed can be decided by a registrar without a
court hearing (unless you request to be heard by a judge).
Rather, two will serve for one year, two for two years, and three for three years. To determine for how
long the first seven trustees will serve, at their first meeting they will draw from a hat numbers 1, 2 or 3 (with
the hat containing two Is, two 2s, and three 3s).

There is significant variation in how district registry offices maintained trust files with some
filing applications regarding trusts in separate sequences.
The charter may include the following:
• the name of the marae
• a general description of the marae reservation
• a list of iwi15, hapū or whānau who are the beneficiaries of
the marae reservation
• the process for nominating and selecting marae trustees
• how trustees are accountable to the beneficiaries
• the process to resolve any conflict between trustees and
beneficiaries
• a recognition of the committees associated with the marae
• the appointment of one or more committees...
The Court gives the Trustees control of the Trust Property so that the Trustees can deal
with the Trust Property, for the benefit of the Beneficiaries. How the Trustees may hold
and deal with the Trust Property is subject to the terms of this Trust.
