Land whose beneficial ownership the Māori Land Court has determined by
freehold order (that is, the Court has created a title for the land and determined the
beneficial owners tothat land).
Two sections of the Trustee Act 1956 that were used from time
to time by Māori land trusts have been carried over to the new
Trusts Act:
• Trustees may apply to the Māori Land Court for directions
about the trust property or the use of their powers or
functions.1
• The Māori Land Court may relieve atrusteefrom personal
liability if they have acted honestly and reasonably and
.
• Not to bind or commit trusteesto future exercise of
discretion
Atrustee must not act in a way that commits trustees in
future to exercising or not exercising a discretion
Where a determination or order has already been made by a registrar, affected persons may also
apply to the court to seek a review of that determination or order.
Please note that you and any potential trusteesand committee of management members nominated do not have any authority to act as a trust or corporation until your application hasbeen approved by a judge or registrar.
