The only exception under the 1964 Act is for religious groups, who are still entitled to apply to the Minister of Health for permission to setup burial grounds on private land for the exclusive burial of their members.
An easement that joins on to a state highway requires the
consent of Waka Kotahi. The consent will set out how the
accessway should be formed. You can get further details
about a consent from the district council or a surveyor.
It gives an inaccurate impression of
how the Act operates and fails to explain in any reasoned way how the Act inhibits
(or enhances) Māori land owners’ aspirations.
Given
the varied circumstances in which special aid may be granted, we do not consider
that an inflexible rule, or set of criteria, should be applied. Rather, a grant of
special aid is a relevant factor to be taken into account on a case-by-case basis.
