If you want to make an application to the Māori Land Court
or you have an application already in the Māori Land Court
that is being delayed by a dispute, you can apply to use the
dispute resolution service to attempt to settle the dispute
outside of a court sitting. A judge may also refer any issue
arising in court proceedings to mediation.
If at any stage your application is considered to not be ‘simple
and uncontested’ a registrar can refer it to a judge to be heard.

The
underlying legal theory is referred to today as
‘Crown pre-emption’, and was reflected in Article
2 of the Treaty of Waitangi, local ordinances, and
government land purchasing practice.
