If an owner with Māori Land interests is deceased, and a succession has not previously been dealt with by the Court or a Registrar, you can use this form to seek a determination from the Court as to those persons entitled to a deceased’s Māori Land interests and an order transferring the interests to those entitled.

Introduction While hearing succession applications I often find myself suggesting to those appearing in front of me to consider forming a whānau trust.
From 6 February 2021 Simple and uncontested succession applications can be decided by a registrar of the Māori Land Court without a court hearing.
Examples of what could be considered ‘simple’ trust matters include: • forming a whānau trust for a single owner’s interests or shares; or • terminating a kaitiaki trust for a minor when the person reaches 20 years of age; or • appointing a trustee to a whānau trust.

Following the initial success of a fixed term FTE over a 12-month period, a further 2.0 permanent FTE and an additional 6-month fixed term FTE have been added to the team.
You can apply to create a whānau trust through an application for succession, or as a stand-alone application.
If you do not intend to seek a grant of probate or administration in the estate you should complete the application for succession without administration on Form 22.
