disputes related to Māoriland through a free tikanga-based
dispute resolution service provided by the MāoriLandCourt.
Historically, most succession applications were heard by a
MāoriLandCourt judge.
Now, if your succession application is assessed to be ‘simple
and uncontested’, then it can be decided by a MāoriLandCourt registrar without a court sitting (unless you request to
be heard by a judge in a court sitting).

Two sections of the Trustee Act 1956 that were used from time
to time by Māoriland trusts have been carried over to the new
Trusts Act:
• Trustees may apply to the MāoriLandCourt for directions
about the trust property or the use of their powers or
functions.1
• The MāoriLandCourt may relieve a trustee from personal
liability if they have acted honestly and reasonably and
ought to be excused for a breach.2
