Māori Land Update –
Ngā Āhuatanga o te whenua
May 2023 | Haratua 2023
This update is issued by the Office of the Chief Registrar, Māori Land Court | Te Kooti Whenua Māori
as part of the ongoing efforts to help inform and assist owners, organisations and government
agencies about the characteristics of Māori Customary and Māori Freehold Land.
If agreement is reached through mediation, your mediator
will record it and provide it to the Māori Land Court. The judge
may then make a court order to formalise the agreement.
However, it is important to check the lease as:
(a) The lease may prevent the registration of a mortgage against the leasehold
estate; and
(b) The lease may also require that the lessor has to approve the mortgage (the
lessor is the person or administration structure who granted the lease, who will
usually hold the title to the land).
