Section 4 of the 1862 Act allowed the Governor to establish a Court or Courts which had the function of investigating ‘who according to Native custom are the proprietors of any Native Lands and the estate or interest held by them therein’. Once land had been investigated, it would then be Crown- granted to the owners as fixed by the Court.
