Following the signing of the Treaty of Waitangi in 1840, the Crown negotiated several largescale purchases of land in Te Waipounamu (the South Island) whereby almost the entire land base of Ngāi Tahu, some 34.5 million acres of land, was sold for £14,750. 1 Ngāi Tahu’s landlessness was the subject of several Crown investigations in the mid-to-late nineteenth century.

Any officer, committee of management member, or employee of an incorporation can be required to appear in court and provide a written or oral report to a judge as part of an investigation.
However, “alienation” is broadly defined in Te Ture Whenua Māori Act 1993. For instance, an alienation includes the making or grant of any lease, licence, easement, mortgage or charge or any kind of encumbrance or trust in respect of the land in the reservation.
