In such a case the applicants would be wise to check the local authority district plan to see whether any restrictions on land use may be applicable to the area proposed for an urupā.
Currently under the Act it is not possible to appoint a trustee or trustees to administer land in such circumstances because the Court is required to be satisfied that the owners “have had sufficient notice of the application and sufficient opportunity to discuss and consider it” per s 215(4)(a).

The Court may, on considering such notice, arrange for the application to be set down for formal hearing or rehearing as the case may be.
In such circumstances it may be worth applying to Court to see whether the trustees can grant leases or licences for a term exceeding seven years, with rights of renewal for one or more terms, which may exceed 14 years in total. Until such an application is made there is no guarantee as to how the Court would view the matter and the success of any such application would depend on its own facts.
