Examples of what could be considered ‘simple’ trust matters
include:
• forming a whānau trust for a single owner’s interests or
shares; or
• terminating a kaitiaki trust for a minor when the person
reaches 20 years of age; or
• appointing a trustee to a whānau trust.

A trustee has a duty to:
• Know the terms of the trust
• Act in accordance with the terms of trust
1. Persons bound to deal with property on behalf of the owners or beneficiaries.
• The trustees can only grant a lease or occupation
licence of the land for a term of up to 14 years (including
renewals), unless the lease or occupation licence is for
education, health or papakāinga housing, in which case
there is no time limit.
• Any lease or occupation licence on a Māori reservation
needs MLC’s consent
