If an owner of Māori
freehold land in multiple ownership has paid more than their share
of water services changes, they can apply to the Māori Land Court
under section 99 of the Act for a charging order to recover the
excess amount paid.
Unlocking finance is an important part of facilitating the occupation, development, and utilisation of whenua Māori for the benefit of owners, their whānau, and their hapū and this practice note is another step on the road to realising this vision.
Its purpose was to register all outstanding Māori Land Court orders relating to Māori land ownership in LINZ. The project continued to receive support from the National Government to its completion.
Since the passing of Te Ture Whenua Māori Act 1993, our role is to:
promote the retention of Māori land in the hands of its owners, whānau and hapū
facilitate the occupation, development and use of Māori land
ensure that decisions made about Māori land are fair and balanced taking into account the needs of all the owners and their beneficiaries.
Holds the trust property, invests its funds and disposes of its assets, as the
responsible trustees in writing direct; executes all documents and perform all such
acts as the responsible trustees in direct writing.
12. A change of ownership of land gives the recipient of that interest the ownership
and its associated rights (land may be vested in a trustee, or shares may be vested
in another person).
