The principal criteria
applied by the Court in these cases were based
on occupation and descent. Groups were usually
required to show that they were descended from
a recognised ancestor on the block and to prove
continuous occupation down to 1840 (although
the Court was not always consistent in this).

What has changed?
LEASE OR OCCUPATION LICENSE:
Trusts over Māori reservation land may issue a lease or
occupation license to enable the land to be occupied or built
on for a period of time.
MEMORIAL SCHEDULE
Shows alienations (eg mortgages, leases, licences,
easements, encumbrances, Sale and Purchase
Agreements etc); various orders (eg as title, trust,
agency, injunction, rights, consolidation etc), and other
updates or important notices etc relating to the block.
The owners have/have not* been advised
(a) that an occupation order may pass by succession; and
(b) that an occupation order may be for a definite term or until a specified event; and
(c) of the term for which the order is sought.

These provisions also apply to an occupation order as if it
were a beneficial interest in Māori land, provided the person
owns a beneficial interest in the land to which the occupation
order applies and the Court is satisfied the person should
succeed to the occupation order.
