APPLYING FOR AN OCCUPATIONORDERApplicants must include all required consents (see above)
with their application, including minutes of the owners’
meeting and the advertisement.
Contact your trust about an occupation license or lease.
Before applying to the Māori Land Court for an occupationorder, you will need consent from the other owners of the
land, and if applicable, from trustees or the management
committee of the Māori incorporation over the land.
These provisions also apply to an occupationorder as if it
were a beneficial interest in Māori land, provided the person
owns a beneficial interest in the land to which the occupationorder applies and the Court is satisfied the person should
succeed to the occupationorder.
The owners have/have not* been advised
(a) that an occupationorder may pass by succession; and
(b) that an occupationorder may be for a definite term or until a specified event; and
(c) of the term for which the order is sought.
