Before

A beneficiary of a whānau trust is not able to apply for an
occupation order to use trust land for housing purposes.
From
6 February 2021
The Māori Land Court can grant an occupation order to a
beneficiary of a whānau trust.
You can visit one of our offices to view:
current and historic ownership lists for whenua Māori
minutes of hearings of Court and Registrar decisions
current and historic memorial schedule information recording leases, occupations and other land uses
orders made by the court or a Registrar – including:
title orders (creating Māori land)
trust orders (names of trustees and terms of trust)
succession orders (names of successors to an estate)
vesting...
In this case, you can talk directly to the trustees about occupying or building on the land and they can approve your plans without court involvement, if the trust order allows it.
An ahu whenua trust:
holds the trustees legally responsible for the management of the land, and
uses a Māori Land Court-approved trust order, which sets out the rights and responsibilities of the trustees and beneficial owners.
